1. ACCEPTANCE OF TERMS
When you visit vinova media, you agree to abide by these Terms & Conditions and consent to our Privacy Policy. If you do not agree to any of the terms, please discontinue use of our website immediately. You agree not to use our website for any unlawful purposes and to comply with all applicable laws and regulations. You also agree not to use the website in any manner that could impair its performance, corrupt its content, or hinder its functionality, and not to compromise its security or access restricted areas.
These Terms & Conditions govern your use of the website, vinova media, accessible at https://vinovamedia.com/. By using this website, you accept all terms and conditions herein. You must not use this website if you disagree with any part of these Terms & Conditions.
2. CLIENT OBLIGATIONS The Client agrees to:
Cooperate with vinova media by providing all necessary information, materials, and access to resources required for the provision of services.
Provide timely feedback and approvals throughout the work process to ensure smooth delivery of services.
3. PAYMENT TERMS
The Client shall pay vinova media the fees set forth in the Statement of Work (SOW) or proposal.
In the event of late payment, vinova media reserves the right to suspend or terminate the Services until payments are up to date.
4. INTELLECTUAL PROPERTY RIGHTS
vinova media retains all intellectual property rights in any designs, code, software, or other deliverables created in connection with the Services, unless otherwise agreed to in writing.
The Client is granted a non-exclusive, non-transferable license to use such deliverables for internal business purposes only
5. CONFIDENTIALITY
Both parties agree to maintain the confidentiality of any confidential information disclosed during the course of the Services. vinova media will take reasonable measures to protect the confidentiality of the Client’s information.
6. WARRANTIES AND REPRESENTATIONS
vinova media represents and warrants that the Services will be performed in a professional and workmanlike manner, consistent with industry standards.
The Client represents and warrants that it has the legal right to provide any materials or information provided to vinova media in connection with the Services
7. LIMITATION OF LIABILITY
vinova media shall not be liable for any indirect, consequential, special, or punitive damages arising from or in connection with the Services, whether in contract, tort, or otherwise, even if advised of the possibility of such damages.
The total liability of vinova media for any claim related to the Services shall not exceed the total fees paid by the Client under the applicable SOW or proposal.
8. TERMINATION
Either party may terminate the Services for any reason upon written notice to the other party.
In the event of termination, the Client shall pay vinova media for all services performed up to the termination date.
9. FILING A COMPLAINT
In the event of any dissatisfaction with our services, vinova media will make every effort to resolve the issue through mutually acceptable solutions.
Complaints should be submitted in writing to our customer service department. We will evaluate the claim and attempt to reach a resolution before any formal complaint is filed.
10. REFUND POLICY
vinova media handles each project professionally to deliver what is stipulated in the proposal. Please note the following refund conditions:
Initial Design Concepts: Once initial design concepts are approved or a revision is requested, any deposited fees will not be refunded, unless vinova media cancels or terminates the contract for reasons other than Client breach or non-performance.
Refund Request Timing:
Before Initial Concept Delivery: If you request a refund before the initial design concepts are delivered, you are eligible for a full refund less a 10% service and processing fee. Within 48 Hours After Delivery: A refund request submitted within 48 hours after receiving the initial design concepts will be eligible for a 66% refund (less 10% service fee).
Between 48 and 120 Hours After Delivery: A refund request in this period will be eligible for a 33% refund (less 10% service fee).
After 120 Hours: No refund requests will be considered.
Additional Conditions:
If no action is taken on the order within 30 days, the Client is not eligible for a refund. Once final files have been delivered or the website is launched, no refunds will be issued.
Refunds for video animation packages are not available once the storyboard has been approved.
Refund requests due to a change of mind or personal reasons are not eligible. If a Client is found to have engaged multiple design agencies for the same project to claim a refund, vinova media reserves the right to decline the refund request.
Processing Time: Approved refunds will be processed within 12-15 business days.
Non-Refundable Services:
Services such as website hosting, domain purchase, SSL certificates, website maintenance, SEO plans, social media marketing, and advertising campaigns are not eligible for refunds.

b. Non-Returnable Services:
Certain custom or personalized services that have been used or consumed are non-refundable.
To request a refund, the Client must contact our customer service with proof of purchase, the reason for the refund, and any additional required information. The refund decision will be made on a case-by-case basis.
